It can be a good idea to sometimes use an out of court settlement. It can save a lot of stress and money and may mean that things can be settled more easily. This is called mitigation and is fairly common, especially in cases where one party is wanting money from another one. It is not appropriate for all cases but when it is possible then it is likely to be the best option to use.

What happens here is that a special mitigation lawyer will talk to both parties. They will work together as a group to try to come to a settlement which both parties are happy with. The lawyer serves as a go between, speaking to both parties alone and then trying to help them come together to an agreement which is fair and that they both agree on.

There are many advantages to this. It means that things can possibly be settled more quickly and in a less stressful manner. Both parties can state their case and then if they are pretty close to agreement, it may just take a few words from the mitigation lawyer to help them see what is fair and agree to settle. By saving them having to take each other to court, it can mean that they save a lot of money as court fees can be very expensive.

Court cases can go on for some time and be very stressful. It is great if this situation can be avoided. People do not always realise how stressful they can be and by just discussing things with a lawyer, rather than having to go through the courts, it can really help to make things easier.

Of course, there may be a case where the parties just do not agree and then it may have to go to court.
